On March 31, 2010 the plaintiff, Trevor Nelson, was cycling in the eastbound curb lane through the intersection of Hastings and Nanaimo Streets in Vancouver when he collided with a large right-turning truck (the "Accident"). The truck was driven by the defendant, Joseph Conarroe, and owned by the defendant, Lafarge Canada Inc. After signalling his intention to do so, Mr. Conarroe turned right from Hastings onto Nanaimo without noticing Mr. Nelson on his bicycle nearby before, during or immediately after the Accident.
